A verified petition has been filed by SPOUSES DONYS A. LABASAN and NONA C. PENPILLO LABASAN, both of legal ages, married and a residents of 2nd Street, Amy’s Ville Subdivision, Mandurriao, Iloilo City praying that judgment be rendered declaring petitioners the parents by adoption of Kaela Shane Penpillo Armada and entitled to carry the surname Labasan.

It is further alleged that petitioners are childless and they desire to adopt the minor Kaela Shane Penpillo Armada, who was born in Iloilo City on October 17, 2006 to Spouses Brian R. Armada and Ada Penpillo Armada as shown by the certificate of live birth thereto attached as Annex "B"; that after the birth of said Kaela Shane, her biological parents entrusted said minor child to petitioners because petitioner wife is the sister of Ada Penpillo Armada and since then up to the present the minor child has been in the custody of petitioners in the above-stated residence address; that petitioner love Kaela Shane, take good care of her and treat her as their own daughter; that the biological parents have voluntarily given their consent to the adoption of Kaela Shane and their written consent will be attached as Annex "C"; that petitioners are possessed of full civil capacity and legal rights and are more then sixteen (16) years older that Kaela Shane; that petitioners are of good moral character and have not been convicted of any crime involving moral turpitude, emotionally and psychologically capable of caring for children and are likewise financially able of supporting Kaela Shane in keeping with the means of the family and have all the qualifications and none of the disqualifications of being adopters; and that the aforesaid Kaela Shane has no property of her own and her adoption by petitioners will serve her best interest and welfare.

WHEREFORE, finding the petition to be in proper form and substance, let the same be set for hearing on March 26, 2010 at 8:30 o’clock in the morning before this branch at which date, time and place, any person who have interest may appear and show cause why the petition should not be granted.

Ms. Vivian Melancio, Social Worker, Social Service and Counseling Division, Office of the Clerk of Court, Regional Trial Court, Iloilo City, is hereby ordered to conduct a case study of the petitioners as well as the minor sought to be adopted and to submit its report and recommendation on or before the date of hearing.

Let copy of this order be published in a newspaper of general circulation in the City and Province of Iloilo once a week for three (3) consecutive weeks and another copies be posted at four (4) conspicuous places in the City and Province of Iloilo.

Furnish the Office of the Solicitor General, Manila, the SSCD, RTC, Clerk of Court, Iloilo City, the petitioners as well as the counsel, a copy each of this order.

P E T I T I O N

COMES, NOW, the Petitioner, through counsel, unto this Honorable Court, most respectfully alleges, that:

1. The Petitioner is of legal age, Filipino and a resident for so many years of the Municipality of San Lorenzo, in the Province of Guimaras, Philippines, but is presently an Overseas Contract Worker at Singapore, while the Respondent is likewise of legal age, Filipino and a resident of La Carlota City, Negros Occidental, Philippines but is also presently an Overseas Contract Worker based at Singapore whose current exact address thereat is not known to the Petitioner.

2. The Petitioner and the Respondent had contracted a civil marriage, a marriage done in haste in view of the unexpected pregnancy of the Respondent, who was then about one (1) month pregnant, in the City of Bacolod on July 24, 1998 and was solemnized by a Judge of the Municipal Trial Court in Cities of said place;

3. The Petitioner and the Respondent, in relation to the aforesaid marriage, had signed a Marriage Contract on the same date and place, a machine copy of which is hereto attached as Annex "A" and made an integral part of this Petition;

4. In said civil marriage, there was someone who was requested by the Respondent through her contacts to take care of all the details and arrangement of the marriage and the Petitioner was merely made to sign the Marriage Contract, considering that the Respondent is a native of Negros Occidental;

5. The aforesaid marriage was solemnized in the absence of a marriage license;

6. The entry in the attached Marriage Contract that the marriage is one of an exceptional character under Article 34 of Executive Order No. 209 as amended has no factual basis for reason that the Petitioner and the Respondent had not lived together nor cohabited with each other under one roof as husband and wife for a period of five (5) years prior to the marriage on July 24, 1998;

7. The Petitioner and the Respondent had not lived together nor cohabited with each other under one roof as husband and wife for five (5) years prior to the marriage on July 24, 1998 for reason that the latter was all along working abroad and resides at her parents’ house whenever she is in the Philippines at La Carlota City, Negros Occidental, while the Respondent maintains residence at the Municipality of San Lorenzo, in the Province of Guimaras, and, if working abroad, also resides in another place;

8. Although Article 34 of Executive Order of 209, as amended, requires that the contracting parties to a marriage shall state in an affidavit before any person authorized by law to administer oaths that they had lived together as husband and wife for at least five (5) years prior to the marriage and without any legal impediment to marry each other in lieu of a marriage license, but, as far as the aforesaid marriage of the parties is concerned however, the Petitioner cannot recall that he executed or that he was made to sign such affidavit or that if he was made to sign one, the Petitioner was not aware nor was he made aware of the contents thereof;

9. Out of the marriage, the Petitioner and the Respondent begot a child named, Alexia G. Magan, a minor;

10. The Petitioner and the Respondent had not acquired real properties nor personal properties of significant values out of the marriage;

11. In order for the Petitioner to straighten his legal status on record by way of a judicial declaration, Petitioner filed this Petition;

P R A Y E R

WHEREFORE, premises considered, specifically on the absence of a marriage license, it is most respectfully prayed of this Honorable Court that the marriage contracted by the Petitioner with the Respondent on the 24th day of July, 1998 before the Municipal Trial Court in Cities of Bacolod City be declared NULL and VOID AB INITIO.

Petitioner further prays for such other relief and remedies just and proper in the premises.

That if I should thereafter learn that any such action or proceeding has been filed other than said Civil Case No. 08-0188, or is pending before the Supreme Court, the Court of Appeals or any other tribunal or agency, I hereby undertake to report such fact within five (5) days therefrom to this Honorable Court.

A verified petition has been filed by SPOUSES DONYS A. LABASAN and NONA C. PENPILLO LABASAN, both of legal ages, married and a residents of 2nd Street, Amy’s Ville Subdivision, Mandurriao, Iloilo City praying that judgment be rendered declaring petitioners the parents by adoption of Kaela Shane Penpillo Armada and entitled to carry the surname Labasan.

It is further alleged that petitioners are childless and they desire to adopt the minor Kaela Shane Penpillo Armada, who was born in Iloilo City on October 17, 2006 to Spouses Brian R. Armada and Ada Penpillo Armada as shown by the certificate of live birth thereto attached as Annex "B"; that after the birth of said Kaela Shane, her biological parents entrusted said minor child to petitioners because petitioner wife is the sister of Ada Penpillo Armada and since then up to the present the minor child has been in the custody of petitioners in the above-stated residence address; that petitioner love Kaela Shane, take good care of her and treat her as their own daughter; that the biological parents have voluntarily given their consent to the adoption of Kaela Shane and their written consent will be attached as Annex "C"; that petitioners are possessed of full civil capacity and legal rights and are more then sixteen (16) years older that Kaela Shane; that petitioners are of good moral character and have not been convicted of any crime involving moral turpitude, emotionally and psychologically capable of caring for children and are likewise financially able of supporting Kaela Shane in keeping with the means of the family and have all the qualifications and none of the disqualifications of being adopters; and that the aforesaid Kaela Shane has no property of her own and her adoption by petitioners will serve her best interest and welfare.

WHEREFORE, finding the petition to be in proper form and substance, let the same be set for hearing on March 26, 2010 at 8:30 o’clock in the morning before this branch at which date, time and place, any person who have interest may appear and show cause why the petition should not be granted.

Ms. Vivian Melancio, Social Worker, Social Service and Counseling Division, Office of the Clerk of Court, Regional Trial Court, Iloilo City, is hereby ordered to conduct a case study of the petitioners as well as the minor sought to be adopted and to submit its report and recommendation on or before the date of hearing.

Let copy of this order be published in a newspaper of general circulation in the City and Province of Iloilo once a week for three (3) consecutive weeks and another copies be posted at four (4) conspicuous places in the City and Province of Iloilo.
