Upon extra judicial Petition for Foreclosure and Sale under Act 3135 as Amended, filed by BANGKO BUENA CONSOLIDATED, INC. formerly Bangko Buena Inc., a banking institution duly organized under Republic Act No. 720 as Amended, with principal office and place of business at # 23 Valeria-Rizal Streets, Iloilo City, as mortgagee, against LENY A. NOMBREDA for herself and as Attorney-In-Fact of JULIUS A. NOMBREDA, both of legal age, Filipinos and a residents of 112 Osmeña Street, Arevalo, Iloilo City, as mortgagors, for the satisfaction of the mortgaged indebtedness which as of December 8, 2011, the total obligation amounted to FOUR HUNDRED SIXTY EIGHT THOUSAND SEVEN HUNDRED FORTY ONE PESOS (P468,741.00) PHILIPPINE CURRENCY, including penalties, aside from Attorney’s fees and other charges that may accrue hereafter, Sheriff’s fee and all other necessary expenses that may be incurred in the enforcement of the extra judicial foreclosure, the undersigned ANNOUNCES, that on February 28, 2012 at 10:00 o’clock in the morning or soon thereafter at the Office of the Clerk of Court, Regional Trial Court, Iloilo City will SELL at PUBLIC AUCTION to the highest bidder for cash, the mortgaged property described hereunder, with all the improvements thereon, to wit:

Prospective BIDDERS and/or BUYERS may investigate for themselves the TITLE of the above described property and the encumbrances existing thereon if any there be.

PROBATE OF WILL OF THE DECEASED ROMEO SIMPAS JARDENIL

Petitioner.

O R D E R

A petition for probate of will of the deceased Romeo Simpas Jardenil was filed by Jennifer S. Torcella through counsel praying that upon proper notice and hearing, the above-mentioned Will be admitted to probate; that petitioner be temporarily appointed as administratrix of the decedent’s estate until such time that the named executor in the will be contacted, appears and qualifiers; that once admitted and in the absence or incapacity of the executor named in the will, letters testamentary be issued to herein petitioner to serve as such without bond.

The petition alleges that:

"The petitioner is of legal age, Filipino, and a resident of Pob. Sta. Barbara, in the Province of Iloilo; the petitioner has just came across of the Last Will and Testament of the deceased Romeo Simpas Jardenil who died in City of Iloilo on October 17, 2006, a photostatic copy of said Last Will and Testament, a Holographic Will, is hereto attached as Annex "A", and made an integral part of this petition, the original thereof to be presented to this Honorable Court at the time of probate; the deceased was an inhabitant of the Philippines and a resident of Iloilo City at the time of his death and left no issue or compulsory heir; the petitioner is the only testamentary heir of then deceased in the said will; the estate left by the decedent consists of his ONE-NINTH (1/9) undivided share in real properties included in the estate of his late mother REMEDIOS VDA DE JARDENIL who pre-deceased him and properties in his name, the gross value of which is estimated at P950,000.00 more or less; the testator, at the time of the execution of the said will, was 60 years of age, of sound and disposing mind, and not acting under duress, fraud, or undue influence and was in every respect capacitated to dispose of his estate by will; although one Mamerto Peccio is the named executor of the decedent’s last will and testament, his whereabouts however is not known; before the named executor in the will be contracted and appears, there is a need for the appointment of a temporary administrator of the decedent’s estate and the petitioner is competent, able and willing to act as such."

Finding the petition to be sufficient in form and substance, the same is hereby set for hearing on March 6, 2012 at 8:30 in the morning. At the session hall of Branch 37, Regional Trial Court, Iloilo City, at which date and hour, anyone and/or all concerned may appear to contest the allowance thereof.

Let this Order be published in NEWS EXPRESS a newspaper of general circulation, in the Province and City of Iloilo for three (3) weeks successively, prior to the date of hearing of the petition, at the expense of the petitioner.

Let a copy of this Order be furnished to the designated or other known heirs, legatees, and devises of the testator resident in the Philippines at their places of residence at least twenty (20) days prior to the day of hearing.
